Vacation Rental Contract

This Vacation Rental Agreement, dated June 19th is between OFFICIAL NAME OF THE RENTAL PROPERTY, a Costa Rican Company with ID number  NUMBER and YONATAN KLYUEV, GUEST PASSPORT NUMBER AE616010.  Vacation Nosara , a Costa Rican Company with ID number 3-102-775149  will act as Booking Agent and Skipper Property Management SRL, a Costa Rica Company with ID number 3-102-707291 will act as Property Manager. All policies in this Vacation Rental Contract are strictly enforced.

1.Property. The property referred to is CASA GIRASOL  located in GUIONES Nosara, Costa Rica. The house is furnished, and includes all amenities listed herein.

2.Term of Rental. This Vacation Rental begins  January 14th to January 21th 2023.

5.Cancellations.  If the Guest cancels due to COVID19, 7 days or less before check-in, the Guest will forfeit the total rental. The total rental includes all charges on the paid-in-full invoice. If the Guest cancels between 7 and 60 days before check-in due to COVID19, the Guest will be given back 50% of the rental. The Guest may mitigate this loss by purchasing Travel Insurance or Cancel for Any Reason insurance. The homeowner has also the right to cancel the booking between 7 and 60 days before the check-in date due to COVID19 (mandatory quarantine, borders closed or beaches closed, etc.) giving back the full amount paid to the Guest.

All cancellations must always be submitted by email. Please email your Booking Agent immediately at  team@vacationnosara.com  in the event you want to cancel your reservation.  

Cancellations made 90 days or more (prior to the arrival date) will be charged a $300 (plus 13% Costa Rica Sales Tax) Cancellation Fee and refunded all remaining monies (* All bank wire fees previously paid are not refunded. In addition, any newly incurred wire fees during the refund process are at the Guest’s expense). 

Cancellations made less than 90 days from the Check-in Date, forfeit all monies paid unless the Unit/House is resold.  In the event the cancelled House/Unit is resold at equal value, reimbursement will be made to the Guest and the Guest will be charged $300.00 (plus 13% Costa Rica Sales Tax) cancellation fee.  There are absolutely no refunds given of any kind for early check out or late arrival.

If the guest is unable to travel due to Governmental Border restrictions due to Covid 19 from either Costa Rica or the United States  the owner will grant a full refund on the rental.  The $300 cancellation fee (plus 13% Costa Rica Sales Tax) will apply.

A $300.00 USD (plus 13% Costa Rica Sales Tax)  Cancellation Fee applies to ALL cancellations made after 48 hours from the time that the Reservation was confirmed.

7.Falsified Reservations. Any reservation obtained under false pretense will be subject to forfeiture of advance payment, deposit and/or rental money, and the party will not be permitted to check-in. 

8.Guests. The number of guests in the Guest’s party that will be staying at the property, will match the number of guests disclosed by guests at time of booking. 

9.Check In / Arrival. Check in is 4pm Costa Rica Time Zone. Please understand that preparing the house takes time to make your stay as comfortable as possible. If you arrive substantially earlier than 3pm, please contact your Vacation Manager to see what can be arranged.  

10.Check out / Departure.  Check out is 11am Costa Rica Time Zone.  If you are checking out prior to 11am, your Vacation Manager will schedule a specific Check Out time with you at time of your Arrival. The Guest will receive a Pre-Check out notification from a Vacation Manager no later than 48 hours prior to Departure.  

The Guest is required to comply with the Check Out Policy.  1. All dishes must be cleaned, 2. All trash must be taken out to the trash receptacle, 3. Any losses and/or damages must be disclosed immediately to your Property Manager by emailing team@puravidamgmt.com    This Check Out Policy is strictly enforced.  If the Guest does not comply with the Check Out Policy the Credit Card on file for the Reservation will be charged by the Property Manager to cover any extra expenses incurred by the Homeowner and/or Property Manager that were intentionally caused by the Guest.  These expenses include extra Cleaning, needed Maintenance and Repairs from unreasonable use or damage, and any items lost that included but are not limited to Air Conditioner Remotes, TV Remotes, etc.  It is expected that the Home be left in reasonable condition.  Leaving the Home in an unreasonable condition of Cleanliness and/or disorganization will result in the Credit Card on file being charged to cover any extra expenses incurred by the Homeowner and/or Property Manager.

11.Parking. Parking inside and outside of the property is at the Guest’s risk. The Guest is advised not to leave valuables in the car at any time.

12.Security. This home is not equipped with an alarm and this rental does not include a nightly watchman from the hours of 530pm-930pm.  It is the Guest’s responsibility to ensure that the house is locked when the guests leave the house and before going to bed at night.  All doors and windows must be locked. All valuables must be secured and out of sight at all times, and curtains/blinds must be closed. This policy is to mitigate any and all break-ins. In the event of a break in, or theft the Property Manager, nor the Booking Agent will be responsible for damages or missing/stolen property. Contact your vacation  manager at team@vacationnosara.com should you want to schedule a dinner watchman for your stay or additional watchman hours.

13.Limitations of Liability. Neither the Homeowner, Property Manager nor the Booking Agent directly or indirectly will be held liable with respect to any (a) death suffered by Guest or employee, contractor, licensee, invitee, guest, agent, or customer of Guest (each, a “Guest Party”) or any other person, from any causes whatsoever, (b) any loss, theft, damage, or injury to any property outside or within the Property belonging to Guest, any Guest Party or any other person, and Guest agrees to indemnify and hold harmless Homeowner, Property Manager, and Booking Agent for any damages (including reasonable attorney’s fees) that result from such loss, damage of injury. 

In addition, the Homeowner, Property Manager, and Booking Agent shall not be liable for internet, water or electricity outages while occupying the house. Including leased vehicles and any other equipment leased to the Guest or their Party. 

Homeowner, Property Manager, and Booking Agent have no interest in or connection to any tours, boats, or vehicle rentals, and similar activities and have no liability in connection thereto. 

Homeowner, Property Manager, and Booking Agent shall not be liable for events beyond its control which may interfere with the Guest’s occupancy, including but not limited to inclement weather, governmental agencies, acts of homeowners associations, fires, strikes, war, noise or nuisance from other homes. No rebate or refund will be offered in these circumstances.

Nosara is a rapidly growing community and there is no complete guarantee of no construction noise during your stay.

14.Swimming Pool (if applicable) The swimming pool is not gated or supervised. Children need to be supervised at all times. Neither the Property Manager nor the Homeowner will be held liable for any pool-related guest injuries. Please note swimming in the pool with sunscreen will create cloudiness in the water. The Pool is serviced professionally twice a week.  Guests may request extra pool cleanings by contacting the Property Manager via email at team@puravidamgmt.com The professional pool service provider does their best to keep the pool perfect during your stay, but there are often abnormal levels of dust and strong daily winds in the dry season, as well as substantial rains in the wet season that can often compromise the pool balance. There are absolutely no refunds given based on the pool becoming dirty or cloudy during your stay.  

15.Indemnification. Guest agrees to indemnify and hold Homeowner harmless from any liability for personal injury or property damage sustained by Guest or parties invited by Guest onto the property that result from a breach of Guest’s responsibilities contained herein this agreement

16.  Cleaning Services.   

The house will be professionally cleaned prior to check in and furnished with fresh linens, bath towels, two (2) rolls of toilet paper per bathroom, one (1) roll of paper towels, one (1) bottle dish soap, (1) sponge, two (2) small personal soaps per person, and two (2) garbage bags.  Please contact your vacation manager by whatsapp at +506 8452 2482 at least 24 hours in advance should you need additional cleaning services.

17.Bugs and Insects. Neither the Homeowner, Property Manager nor the booking agent shall be responsible for the fumigation or removal of insects that may enter the property.

18.Access to the Property. The Homeowner and Property Manager reserve the right to enter the premises at any time, without notice in the event of an emergency or suspected emergency. The Homeowner and Property Manager reserve the right to enter the premises for maintenance purposes upon reasonable notice to Guest.  The Homeowner and Property Manager reserve the right to enter the premises to show the house to future rental prospects and or prospective buyers of the property upon 24 hours notice.

19.Enforceability. If any term or provision of this Agreement shall, to any extent, be illegal, invalid or unenforceable, the remainder of this Agreement shall not be affected thereby, and all other terms and provisions of this Agreement shall be valid and enforceable to the fullest extent permitted by law.

20.Exceptions. Exceptions to the terms of this agreement must be approved in writing by the Property Manager or Homeowner in advance at the moment of booking. No modification of this Agreement shall be binding or valid unless in writing and executed and delivered by both parties. In the case of Guest, the signatory to the document as well as any third party making a promise to pay, whether for damage waiver, rent, or other charges on behalf of Guest  shall be bound by all terms and conditions of this Agreement.

21.Guest’s Responsibility.

  1. This is a NON-SMOKING property. Smoking inside the house is strictly forbidden.

  2. Towels or linens shall not be taken from the house for any reason.

  3. Property Manager will not rent to Guests under 25 years of age unless accompanied by an adult.

  4. Premises shall be maintained in a clean and responsible condition including the outside grounds.

  5. At Check-out, all debris, rubbish and discards shall be placed in the trash, dishes shall be washed and the refrigerator shall be emptied and cleaned. $50.00 charge to the Guest  for left behind trash, dirty dishes, and/or dirty refrigerator.

  6. All keys shall be returned and safes left open ($150 lost key charge).

  7. All charges accrued during the stay shall be paid prior to departure.

  8. Guests shall not sublease under any circumstances.

  9. Guests shall be responsible for securing and protecting their valuables left in and around the property.

22. Disputes. The parties to this contract hereby agree to resolve legal disputes through

arbitration methods rather than civil lawsuits in Costa Rica and the United States of America.

By submitting an initial and signed Guest Rental Agreement, The Guest agrees and accepts ALL conditions of this contract.
